La r\u00e9cente d\u00e9cision de la Chambre de R\u00e9solution des Litiges (CRD) de la FIFA du 9 d\u00e9cembre 2025 (FPSD-20363) apporte une clarification importante pour les litiges du travail dans le football professionnel (international). Au c\u0153ur de cette d\u00e9cision se trouve une question souvent sous-estim\u00e9e dans la pratique : quand y a-t-il r\u00e9ellement une \u201edimension internationale\u201c qui justifie la comp\u00e9tence de la FIFA ?<\/p>\n\n\n\n

Cette d\u00e9limitation rev\u00eat une importance consid\u00e9rable, en particulier pour les joueurs, les clubs et les avocats, car elle d\u00e9termine si une proc\u00e9dure doit \u00eatre men\u00e9e devant la FIFA ou devant des instances nationales.<\/p>\n\n\n\n

Aper\u00e7u de l'affaire<\/h2>\n\n\n\n

Un joueur serbe a r\u00e9clam\u00e9 des salaires impay\u00e9s \u00e0 un club de Bosnie-et-Herz\u00e9govine. Le club n'a pas contest\u00e9 la cr\u00e9ance sur le fond, mais a soutenu que la FIFA n'\u00e9tait pas comp\u00e9tente. Il a notamment fait valoir que le joueur r\u00e9sidait en Bosnie, qu'il y avait un compte bancaire et qu'il \u00e9tait trait\u00e9 comme un joueur \u201enational\u201c dans la ligue.<\/p>\n\n\n\n

Le club visait ainsi \u00e0 pr\u00e9senter le litige comme purement national et \u00e0 retirer \u00e0 la FIFA sa comp\u00e9tence.<\/p>\n\n\n\n

La question juridique centrale : qu'est-ce qui fonde la dimension internationale ?<\/h2>\n\n\n\n

Dans sa d\u00e9cision, la RDC affirme clairement et sans \u00e9quivoque que seule la nationalit\u00e9 des parties est d\u00e9terminante pour l'\u00e9valuation de la dimension internationale. En revanche, des crit\u00e8res tels que la r\u00e9sidence, le statut de r\u00e9sident ou l'int\u00e9gration \u00e9conomique dans le pays concern\u00e9 ne sont pas d\u00e9terminants.<\/p>\n\n\n\n

Dans ce cas pr\u00e9cis, le joueur \u00e9tait de nationalit\u00e9 serbe, alors que le club \u00e9tait bas\u00e9 en Bosnie-Herz\u00e9govine. Cette circonstance suffisait \u00e0 elle seule \u00e0 conclure \u00e0 l'existence d'un diff\u00e9rend international et donc \u00e0 la comp\u00e9tence de la FIFA. .<\/p>\n\n\n\n

Cette clarification est particuli\u00e8rement pertinente dans la pratique, car dans de nombreux cas, les clubs tentent de construire une classification nationale par le biais de circonstances factuelles et d'\u00e9chapper ainsi au r\u00e9gime de la FIFA.<\/p>\n\n\n\n

Pourquoi le r\u00e8glement de la ligue n'a pas jou\u00e9 de r\u00f4le<\/h2>\n\n\n\n

Le club a fait valoir, entre autres, des r\u00e8glements de ligue selon lesquels les joueurs de certains pays - comme les anciens pays yougoslaves - ne sont pas consid\u00e9r\u00e9s comme des \u201e\u00e9trangers\u201c. La RDC a clairement rejet\u00e9 cet argument.<\/p>\n\n\n\n

Elle a not\u00e9 que de telles r\u00e8gles concernaient exclusivement le droit de participer aux comp\u00e9titions, et non la qualification juridique de la nationalit\u00e9. La question de la comp\u00e9tence internationale (de la RDC) doit \u00eatre strictement s\u00e9par\u00e9e de cette question.<\/p>\n\n\n\n

Il est donc clair que les cat\u00e9gories nationales ne peuvent pas \u00eatre appliqu\u00e9es aux normes de comp\u00e9tence internationale de la RDC .<\/p>\n\n\n\n

Le domicile et les liens \u00e9conomiques ne sont pas pertinents<\/h2>\n\n\n\n

Un aspect particuli\u00e8rement important de la d\u00e9cision est qu'elle \u00e9tablit une distinction claire avec les mod\u00e8les d'argumentation typiques dans la pratique. La DRC souligne que ni le lieu de r\u00e9sidence du joueur, ni ses coordonn\u00e9es bancaires, ni aucun autre point de rattachement local n'entrent en ligne de compte.<\/p>\n\n\n\n

M\u00eame si un joueur vit enti\u00e8rement dans un pays et est \u00e9conomiquement int\u00e9gr\u00e9, le litige reste international s'il existe des nationalit\u00e9s diff\u00e9rentes. Cela permet d'\u00e9tablir une d\u00e9limitation claire et facilement applicable, qui garantit la s\u00e9curit\u00e9 juridique.<\/p>\n\n\n\n

D\u00e9cision mat\u00e9rielle : le silence ne prot\u00e8ge pas<\/h2>\n\n\n\n

La comp\u00e9tence de la FIFA ayant finalement \u00e9t\u00e9 reconnue, la RDC s'est tourn\u00e9e vers la r\u00e9clamation mat\u00e9rielle. Le fait que le club n'ait pas contest\u00e9 le contenu des salaires r\u00e9clam\u00e9s a jou\u00e9 un r\u00f4le d\u00e9cisif.<\/p>\n\n\n\n

La DRC a consid\u00e9r\u00e9 que ce comportement constituait un manquement \u00e0 la charge de la preuve. En cons\u00e9quence, le club a \u00e9t\u00e9 condamn\u00e9 \u00e0 payer la r\u00e9mun\u00e9ration impay\u00e9e d'un montant total de 15 500 KM nets, plus des int\u00e9r\u00eats de retard au taux de 5 % par an. .<\/p>\n\n\n\n

Cette d\u00e9cision montre clairement qu'une strat\u00e9gie de d\u00e9fense purement proc\u00e9durale et formelle comporte des risques consid\u00e9rables.<\/p>\n\n\n\n

Sanctions suppl\u00e9mentaires et cons\u00e9quences sportives<\/h2>\n\n\n\n

Outre l'obligation de paiement, la DRC a \u00e9galement inflig\u00e9 un avertissement au club pour retard de paiement. En outre, il a \u00e9t\u00e9 pr\u00e9cis\u00e9 qu'en cas de non-paiement dans les d\u00e9lais impartis, le club s'exposait \u00e0 une interdiction de transfert pouvant aller jusqu'\u00e0 trois p\u00e9riodes de transfert.<\/p>\n\n\n\n

Cette d\u00e9cision souligne donc une fois de plus que les proc\u00e9dures de la FIFA peuvent avoir un impact non seulement financier, mais aussi sportif important.<\/p>\n\n\n\n

Conclusion<\/h2>\n\n\n\n

La d\u00e9cision de la FIFA RDC fournit une ligne directrice claire et pratique : seule la nationalit\u00e9 des parties est d\u00e9terminante pour la comp\u00e9tence internationale. Ni les classifications sportives\/nationales ni les circonstances de fait ne peuvent modifier cette situation.<\/p>\n\n\n\n

Dans la pratique, cela signifie que les questions de comp\u00e9tence doivent \u00eatre examin\u00e9es avec pr\u00e9cision et \u00e0 un stade pr\u00e9coce. Dans le m\u00eame temps, ce cas montre qu'il est risqu\u00e9 de se concentrer exclusivement sur les objections formelles sans aborder le droit mat\u00e9riel.<\/p>\n\n\n\n

Dans l'ensemble, cette d\u00e9cision renforce la s\u00e9curit\u00e9 juridique du droit du travail international dans le domaine du football et confirme le r\u00f4le central de la FIFA en tant qu'instance charg\u00e9e de faire appliquer la loi en cas de litige transfrontalier.<\/p>\n\n\n\n
