L'UEFA a approuv\u00e9 en octobre 2025 \u201c\u00e0 contrec\u0153ur<\/em>\u201d et \u201eexceptionnellement<\/em>\u201cLa tenue du match de La Liga entre Villarreal et le FC Barcelone le 21 d\u00e9cembre 2025 \u00e0 Miami (voir notamment ici) : https:\/\/www.laola1.at\/de\/red\/fussball\/international\/spanien\/la-liga\/news\/uefa-willigt-ein–barcelona-spielt-ligaspiel-in-den-usa\/<\/a>). Le match de La Liga a finalement eu lieu en Espagne (uniquement en raison des protestations et des joueurs) (voir ici) : https:\/\/www.transfermarkt.at\/barca-gegen-villarreal-doch-nicht-in-miami-laliga-spiel-in-den-usa-abgesagt\/view\/news\/461951<\/a>). <\/p>\n\n\n\n

L'article suivant vise n\u00e9anmoins \u00e0 montrer, en particulier pour l'avenir, sur quelle base juridique ce projet serait possible :<\/p>\n\n\n\n

Qu'est-ce que l'UEFA a \u00e0 voir avec cela ?<\/strong><\/p>\n\n\n\n

Un lecteur int\u00e9ress\u00e9 par le droit du sport se demande imm\u00e9diatement pourquoi l'UEFA (en tant qu'association continentale) a d\u00fb donner son accord. En effet, le match ne devait pas se d\u00e9rouler dans le cadre d'une comp\u00e9tition europ\u00e9enne, mais dans le cadre d'une comp\u00e9tition purement nationale, et il ne se d\u00e9roule pas non plus sur le territoire r\u00e9glement\u00e9 par l'UEFA, \u00e0 savoir l'Europe.<\/p>\n\n\n\n

Comment se d\u00e9roule la proc\u00e9dure ?<\/strong><\/p>\n\n\n\n

Dans ce contexte, il est utile de consulter le r\u00e8glement de la FIFA sur la gestion des matches internationaux (RGIM) et les statuts de l'UEFA, en raison de la proc\u00e9dure d'autorisation \u00e0 plusieurs niveaux (que l'on rencontre souvent).<\/p>\n\n\n\n

Dans l'article 1 du RGIM (\u201eObjects\u201c), la FIFA revendique son pouvoir de r\u00e9glementation sur l'organisation de matches\/comp\u00e9titions entre \u00e9quipes d'associations diff\u00e9rentes ou entre \u00e9quipes d'une m\u00eame association, mais dans un \u201epays tiers\u201c.<\/p>\n\n\n\n

Dans l'article 11.2. et l'annexe B du RGIM, la FIFA stipule ensuite que pour le match qui fait l'objet de cette contribution (\u201ematch international de niveau 2\u201c), il faut d'abord obtenir l'autorisation de la f\u00e9d\u00e9ration espagnole (ce qui aura \u00e9t\u00e9 le moindre probl\u00e8me ici, si l'on sait lire entre les lignes), qui doit \u00e0 son tour demander l'autorisation \u00e0 la f\u00e9d\u00e9ration continentale sup\u00e9rieure - ici l'UEFA.<\/p>\n\n\n\n

Quel est le \u201eprobl\u00e8me\u201c ?<\/strong><\/p>\n\n\n\n

C'est pr\u00e9cis\u00e9ment \u00e0 ce stade de l'autorisation que les statuts de l'UEFA manquent (encore !) de directives concr\u00e8tes, de conditions ou m\u00eame d'interdictions pour un match entre \u00e9quipes de la m\u00eame association\/du m\u00eame pays qui doit avoir lieu en dehors du territoire de l'UEFA. En effet, dans les articles 49 \u00e0 51 de ses statuts, elle ne r\u00e8gle que la proc\u00e9dure d'autorisation pour les matches \u201einternationaux\u201c sur un autre continent (par exemple FC Barcelone contre FC Liverpool \u00e0 Miami). Par cons\u00e9quent, l'UEFA - si elle \u00e9tait appel\u00e9e \u00e0 le faire - \u00e9tait effectivement \u201eoblig\u00e9e\u201c d'organiser le match Villarreal-FC Barcelone, nolens volens<\/em> de l'accepter. Dans le cas contraire, elle aurait probablement agi de mani\u00e8re arbitraire et impr\u00e9visible - un reproche qu'une association continentale ne veut\/peut pas accepter.<\/p>\n\n\n\n

Post-scriptum #1<\/em><\/strong><\/p>\n\n\n\n

Apr\u00e8s avoir obtenu l'autorisation de la f\u00e9d\u00e9ration espagnole et de l'UEFA, les \u00e9quipes organisatrices doivent \u00e0 pr\u00e9sent transmettre ces autorisations \u00e0 la f\u00e9d\u00e9ration am\u00e9ricaine (sur le territoire de laquelle se d\u00e9roule le match), qui doit \u00e0 son tour demander l'autorisation du match \u00e0 la Conf\u00e9d\u00e9ration nord-am\u00e9ricaine de football (CONCACAF).<\/p>\n\n\n\n

Si l'on consid\u00e8re la complexit\u00e9 de l'ensemble de la proc\u00e9dure, qui n'a \u00e9t\u00e9 qu'esquiss\u00e9e, on peut deviner - toujours entre les lignes et avec un peu d'imagination - quels int\u00e9r\u00eats financiers se cachent derri\u00e8re ce jeu, afin que toutes les personnes impliqu\u00e9es en valent la peine, sans parler des fatigues du voyage.<\/p>\n\n\n\n

Post-scriptum #2<\/em><\/strong><\/p>\n\n\n\n

L'UEFA va maintenant r\u00e9fl\u00e9chir attentivement \u00e0 la mani\u00e8re dont elle va affiner ses statuts et autres r\u00e8glements afin d'avoir \u201ela main\u201c sur ces questions \u00e0 l'avenir, sans aucun doute et surtout en toute s\u00e9curit\u00e9 juridique.<\/p>\n\n\n\n
