{"id":2113,"date":"2026-03-15T15:00:32","date_gmt":"2026-03-15T15:00:32","guid":{"rendered":"https:\/\/zellinger-law.at\/?p=2113"},"modified":"2026-03-15T15:03:26","modified_gmt":"2026-03-15T15:03:26","slug":"verjaehrungsfrist-im-internationalen-fussball-art-23-abs-3-fifa-rstp","status":"publish","type":"post","link":"https:\/\/zellinger-law.at\/fr\/verjaehrungsfrist-im-internationalen-fussball-art-23-abs-3-fifa-rstp\/","title":{"rendered":"D\u00e9lai de prescription dans le football international (art. 23, paragraphe 3, FIFA RSTP)"},"content":{"rendered":"<p class=\"has-text-align-left\" id=\"ember71\">Dans sa d\u00e9cision encore tr\u00e8s r\u00e9cente, le TAS a <em><a href=\"https:\/\/www.tas-cas.org\/generated\/assets\/lists\/feb900ba-1137-4b78-a9ff-d68af7869087\/Award_11060__FINAL_for_publ._.pdf\" type=\"link\" id=\"https:\/\/www.tas-cas.org\/generated\/assets\/lists\/feb900ba-1137-4b78-a9ff-d68af7869087\/Award_11060__FINAL_for_publ._.pdf\">CAS 2024\/A\/11060<\/a><\/em> du 19.09.2025 a montr\u00e9 une fois de plus \u00e0 quel point le d\u00e9lai de prescription de 2 ans de l'article 23, paragraphe 3 du RSTP de la FIFA doit \u00eatre interpr\u00e9t\u00e9 de mani\u00e8re stricte. Concr\u00e8tement, il s'agissait d'un joueur qui, suite au non-paiement de son salaire et de ses bonus, avait saisi le FIFA Football Tribunal - mais tardivement. Trop tard, comme il s'est av\u00e9r\u00e9. En effet, le FIFA Football Tribunal ne traite que les plaintes relatives \u00e0 des cr\u00e9ances dont l'\u00e9ch\u00e9ance remonte \u00e0 moins de deux ans.<\/p>\n\n\n\n<p id=\"ember72\">Le joueur a fait valoir que le comportement du club - notamment une pr\u00e9tendue reconnaissance de dette - devait cependant interrompre cette prescription. En vertu du droit suisse des obligations, cela serait en principe concevable. Mais il n'existe pas de disposition correspondante dans les RSTP de la FIFA, ni de lacune involontaire.<\/p>\n\n\n\n<p id=\"ember73\">Le TAS a suivi cette ligne de mani\u00e8re coh\u00e9rente :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La p\u00e9riode de deux ans est r\u00e9glement\u00e9e de mani\u00e8re exhaustive.<\/li>\n\n\n\n<li>Pas d'interruption, pas d'inhibition - m\u00eame en cas de reconnaissance par le club.<\/li>\n\n\n\n<li>Le droit suisse n'intervient pas ici \u00e0 titre subsidiaire.<\/li>\n<\/ul>\n\n\n\n<p id=\"ember75\">Important : La disposition de l'article 23, paragraphe 3, de la FIFA-RSTP concerne <em>exclusivement<\/em> Proc\u00e9dure devant les instances de la FIFA. Pour les actions civiles, la voie reste ouverte pour le joueur m\u00eame apr\u00e8s les deux ans - en particulier pour les contrats de travail, o\u00f9 les RSTP de la FIFA ne pr\u00e9voient d\u00e9lib\u00e9r\u00e9ment aucune exclusivit\u00e9. Dans ce cas, il convient n\u00e9anmoins de respecter les r\u00e8gles nationales en mati\u00e8re de prescription.<\/p>\n\n\n\n<p id=\"ember76\">En particulier, pour les joueurs, leurs agents et leurs avocats, cette d\u00e9cision signifie<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La gestion des d\u00e9lais est essentielle.<\/li>\n\n\n\n<li>Les \u201ereconnaissances\u201c formelles du club ne sont d'aucune aide dans la proc\u00e9dure devant le Tribunal de football de la FIFA.<\/li>\n\n\n\n<li>Les strat\u00e9gies parall\u00e8les -
