{"id":2113,"date":"2026-03-15T15:00:32","date_gmt":"2026-03-15T15:00:32","guid":{"rendered":"https:\/\/zellinger-law.at\/?p=2113"},"modified":"2026-03-15T15:03:26","modified_gmt":"2026-03-15T15:03:26","slug":"verjaehrungsfrist-im-internationalen-fussball-art-23-abs-3-fifa-rstp","status":"publish","type":"post","link":"https:\/\/zellinger-law.at\/es\/verjaehrungsfrist-im-internationalen-fussball-art-23-abs-3-fifa-rstp\/","title":{"rendered":"Periodo de limitaci\u00f3n en el f\u00fatbol internacional (Art. 23 apdo. 3 RSTP de la FIFA)"},"content":{"rendered":"<p class=\"has-text-align-left\" id=\"ember71\">En su todav\u00eda muy reciente decisi\u00f3n, el TAS <em><a href=\"https:\/\/www.tas-cas.org\/generated\/assets\/lists\/feb900ba-1137-4b78-a9ff-d68af7869087\/Award_11060__FINAL_for_publ._.pdf\" type=\"link\" id=\"https:\/\/www.tas-cas.org\/generated\/assets\/lists\/feb900ba-1137-4b78-a9ff-d68af7869087\/Award_11060__FINAL_for_publ._.pdf\">CAS 2024\/A\/11060<\/a><\/em> del 19 de septiembre de 2025 demostr\u00f3 una vez m\u00e1s lo estricto que debe interpretarse el plazo de prescripci\u00f3n de dos a\u00f1os del art. 23 apdo. 3 del RSTP de la FIFA. Concretamente, el caso se refer\u00eda a un jugador que acudi\u00f3 al Tribunal del F\u00fatbol de la FIFA tras haber recibido pagos pendientes de salarios y primas, aunque tarde. Demasiado tarde, como result\u00f3. El Tribunal del F\u00fatbol de la FIFA s\u00f3lo se ocupa de reclamaciones de menos de dos a\u00f1os de antig\u00fcedad.<\/p>\n\n\n\n<p id=\"ember72\">El jugador argument\u00f3 que el comportamiento del club -incluido un supuesto reconocimiento de deuda- deber\u00eda interrumpir este plazo de prescripci\u00f3n. En principio, esto ser\u00eda concebible seg\u00fan el C\u00f3digo de Obligaciones suizo. Sin embargo, no existe una disposici\u00f3n correspondiente en el RSTP de la FIFA, ni tampoco una laguna legal involuntaria.<\/p>\n\n\n\n<p id=\"ember73\">La CAS sigui\u00f3 sistem\u00e1ticamente esta l\u00ednea:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>El periodo de dos a\u00f1os ha finalizado.<\/li>\n\n\n\n<li>Sin interrupciones, sin inhibiciones, ni siquiera cuando es reconocido por el club.<\/li>\n\n\n\n<li>El derecho suizo no interviene aqu\u00ed de forma subsidiaria.<\/li>\n<\/ul>\n\n\n\n<p id=\"ember75\">Importante: La disposici\u00f3n del art. 23 apdo. 3 del RSTP de la FIFA se refiere a <em>exclusivamente<\/em> Procedimientos ante los \u00f3rganos de la FIFA. En cuanto a los procedimientos ante los tribunales civiles, el camino sigue abierto para el jugador incluso despu\u00e9s de los dos a\u00f1os, especialmente en el caso de los contratos de trabajo, en los que el RSTP de la FIFA no prev\u00e9 deliberadamente la exclusividad.
