Why it is often inadmissible"},"content":{"rendered":"<h2 class=\"wp-block-heading\" id=\"h-problem-ich-habe-eine-strafe-bekommen-aber-ist-das-uberhaupt-erlaubt\">Problem: \u201eI've been fined - but is that even allowed?\u201c<\/h2>\n\n\n\n<p>Many drivers experience the following situation:<br>A quick trip to the supermarket - and a few days later they receive a <strong>Penalty order for incorrect parking<\/strong>.<\/p>\n\n\n\n<p>This is also the case in a recent case at our law firm:<br>A client parked in an area of a supermarket car park marked as a disabled parking space. Shortly afterwards, he received a <strong>Administrative fine of EUR 120 for an alleged offence against the StVO<\/strong> .<\/p>\n\n\n\n<p>For those affected, such a penalty order is official and binding. Out of uncertainty, it is often paid immediately.<\/p>\n\n\n\n<p>The central problem:<br>Many of these penalties are legally <strong>Not permitted at all<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-losung-keine-verwaltungsstrafen-auf-privatparkplatzen\">Solution: No administrative fines in private car parks<\/h2>\n\n\n\n<p>The legal situation is often misunderstood:<\/p>\n\n\n\n<p>The following applies to private car parks - for example at supermarkets or shopping centres:<\/p>\n\n\n\n<p><strong>An administrative penalty under the Road Traffic Act requires an official order.<\/strong><\/p>\n\n\n\n<p>In concrete terms, this means<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A parking ban must <strong>duly announced<\/strong> be<\/li>\n\n\n\n<li>The scheme must be approved by the <strong>competent authority<\/strong> have been<\/li>\n\n\n\n<li>Private markings or signage are not sufficient for this purpose<\/li>\n<\/ul>\n\n\n\n<p>In the specific case of our law firm:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The marking of the disabled parking space was <strong>installed by the car park operator<\/strong><\/li>\n\n\n\n<li>One <strong>official regulation did not exist<\/strong><\/li>\n<\/ul>\n\n\n\n<p>This meant that there was no legal basis for an administrative penalty in supermarket car parks.<\/p>\n\n\n\n<p>The distinction is important:<\/p>\n\n\n\n<p>The following may be permissible:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Actions for adverse possession<\/li>\n\n\n\n<li>Contractual penalties by the operator<\/li>\n<\/ul>\n\n\n\n<p>However, this is not permitted:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An administrative penalty under the StVO without a corresponding regulation<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-warum-sie-uns-kontaktieren-sollten-erfolgreich-gegen-die-strafverfugung-vorgegangen\">Why you should contact us: Successful action against the penalty order<\/h2>\n\n\n\n<p>Our law firm has taken the following steps in this specific case:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Appeal against the penalty order within the deadline<\/li>\n\n\n\n<li>Request for the complete administrative act<\/li>\n\n\n\n<li>Checking whether an official regulation actually exists<\/li>\n\n\n\n<li>Clear legal argumentation: No administrative offence without a regulation<\/li>\n<\/ul>\n\n\n\n<p>In the end, the information provided by the municipality was decisive:<\/p>\n\n\n\n<p>The car park markings were <strong>not installed by the authority, but privately<\/strong><\/p>\n\n\n\n<p>The result:<\/p>\n\n\n\n<p>The administrative penal proceedings were <strong>set<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-haufige-fragen\">Frequently asked questions<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-muss-ich-eine-strafverfugung-sofort-bezahlen\">Do I have to pay a penalty order immediately?<\/h3>\n\n\n\n<p>No. An appeal can be lodged against a penalty order within the statutory period. A premature payment can be disadvantageous.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-gilt-die-strassenverkehrsordnung-auf-supermarkt-parkplatzen\">Do the road traffic regulations apply in supermarket car parks?<\/h3>\n\n\n\n<p>Not automatically. The decisive factor is whether an official regulation exists.
